Patent infringement proceedings are won

The Düsseldorf Higher Regional Court, as court of appeal, largely upheld the complaint of Akzenta Paneele + Profile GmbH, a subsidiary of the Classen group, Kaisersesch. Classen reports that the court decided that certain design floorings which were imported and brought into circulation by Project Floors GmbH with a so-called "Unifit" interlocking system violated the German part of the EP 1 415 056 (so-called Megaloc patent). The objection that the products obtained from a Chinese manufacturer were included in the above-mentioned patent by a licence issued by Pergo was dismissed by the court.
